Once again, the Court refuted false information about Igor Sikorsky Kyiv Polytechnic Institute.
We have already informed you that in October 2018, the TV channel and website of the news channel “24” (TOV “Informatsiine ahentstvo 24”) spread disseminated information in the video of the CIA program. Journalists told about the alleged corruption schemes at the University. It dealt with constructing residential complexes and transferring land to developers.
On September 17, 2020, the Commercial Court of Kyiv rejected the appeal of PAT “Teleradiokompaniia “Liuks”. According to the Court, the information, disseminated in October 2018 on the news channel “24” and its website, in the video of the CIA program was found unreliable. It also violated the personal property right of Igor Sikorsky Kyiv Polytechnic Institute.
Afterward, PAT “Teleradiokompaniia “Liuks” filed a decision of the Commercial Court of Kyiv. On February 2, 2021, Igor Sikorsky Kyiv Polytechnic Institute won the case again in the Northern Commercial Court of Appeal because the Court rejected the “Liuks” appeal. In particular, the Court ruling says, ‘... Having examined and assessed all relevant evidence available in the case file, the Court of Appeal concluded that the decision of the Commercial Court of Kyiv of 17.09.2020 in the case № 910/4415 /19 was adopted with a full and comprehensive study of the circumstances relevant to the case, as well as compliance with substantive and procedural law, so the Court won’t allow the claim of the PAT “Teleradiokompaniia “Liuks”. Other arguments outlined in the appeal are unfounded, so the panel of judges rejects the above arguments.’
Once more, Igor Sikorsky Kyiv Polytechnic Institute has won defamation and stood up for what’s right. The TV channel “24” (including its website) is to publish the full text of the operative part of the court decision. Moreover, the news channel “24” is to delete fragments and comments containing inaccurate, defamatory, and degrading information about Igor Sikorsky Kyiv Polytechnic Institute from the TV website.
